1. THE WORK IN ITALIAN CONSTITUTION

Article 1:

"In the Italian Constitution the work is in the centre of society"

Its importance is expressed in a whole of legal rules and fundamental principles, called -work law-

Article 35:

"The Constitution assure an equal protection for all kinds of work. The repubblic must improve the workers’ professional preparation and encourage the agreements that defend the social rights"

The duty to assure the workers’ rights was acquited by the State with the promulgation of numerous laws that assure better condition of work, prohibit forms of exploitation and guarantee more freedom.

The Workers’ Rights Statute recognize to the workers a general right of work tutelage, and prevides specific rules for weaker categories (women and minors). Individual rights and collective rights are dealt in the Workers’ Rights Statute.

 

2. INDIVIDUAL RIGHTS

Article 36

Article 36 tells about of the workers’ reward. The salary must consent him and his family a free existence with dignity. Moreover, this article protects the psyco-phisical healt of the worker, determine the lenght of the day of work, the weekly rest and the yearly holidays.

The discipline of work table

- table of normal work: 40 hours in a week

- extraordinary work: not more than 48 hours in a week

- daily rest: 11 consecutive hours every 24

- break: if the daily work is more than 6 hours

- weekly rest: 24 consecutive hours every 7 days

- 4 weeks of holidays in the year.

This law is valiable for all the sectors except journalists and people who work in public utility services.

Article 38

The article 38 treats the obligation of the State to assist and mantain the workers more in need (pensioners, unemployed and invalids). INPS and INAIL.

3. COLLECTIVE RIGHTS

Article 39

The article 39 tells about the Trade Union. The Trade Union is an association of workers who enrols themselves freely. Saveguarding the rights of workers.

The means which an used to saveguard the workers are:

- the collective contracts that estabilishes the wages, the working, the hours holiday…

- the strike: is a protest to get the salaries and ordinary condition more advantageous. During the strike the worker mustn’t pay the damages caused by the lack of the work. The strike is permitted when it’s:

o a collective absention from the work, declared by a trade union organization

o a voluntary absention

The workers who are employed on health services and at the pubblic transport can strike, but they must guarantee the minimal and necessary work for emergencies .

4. ORIENTATION AND JOB

The neo-diploma guys can reach the world of business through:

- curriculum vitae: presentation of the document in which they introduce themselves, exhibit their own worked experiences and the own specific knowledge ( foreigne languages, computer science …)

- agency of temporany work: agency which provides the enrollement a work for few months in different agency, in sostitution of the infortunate or ill workers.

5. "STAGE"

The "Stage", or formation apprenticeship, is the more immediate and frequent way to reach the world of business; this type of activity allows the students to know the world of business. Stage are short periods of time, usually in summer, in which the students work, without any reward, in some firms.

Mosè Bianchi school was one of the first schools in Italy that began with the stage project. The idea arose when the law of the reform of cycles came into force, which insisted on the relationship between school and business. Moreover, the reform of final exams provided the formative credit system for the people who takes part in this experience.

The students who take part in this project are the students of forth classes (17 years old) and the cleverest ones of third classes (16 years old). The firms require them some skills: the "AUTOCAD" (for the surveyors) and the knowledge of computer science. All have to speak at least two foreign languages. The kind of firms that take part in this project are: local municipality, "ASL" (local Health Body), banks, private offices, private and pubblic firms. Often, after the final state exam (18 years old), the firms who are involved in the stage employs students who spent the stage time with them.
